Terms of Service

These Terms of Service (hereinafter "Terms") set forth the conditions for using setups. (hereinafter "Service"). Please read these Terms carefully before using the Service.

Article 1 (Application)

  1. These Terms shall apply to all relationships between users and the Operator regarding the use of the Service.
  2. In addition to these Terms, the Operator may establish various rules and regulations regarding the use of the Service (hereinafter "Individual Provisions"). These Individual Provisions, regardless of their names, shall constitute part of these Terms.
  3. If the provisions of these Terms conflict with the Individual Provisions, the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.

Article 2 (Service Description)

  1. The Service is a platform for sharing and discovering desk setup photos.
  2. Users can use features such as posting photos, adding product information pins, and viewing/saving other users' setups.
  3. The Operator may analyze user usage patterns and provide personalized content to improve the quality of the Service. Please refer to our Privacy Policy for details.

Article 3 (User Registration)

  1. Registration for the Service is completed when a registration applicant agrees to these Terms, applies for registration in the manner prescribed by the Operator, and the Operator approves such application.
  2. The Operator may not approve a registration application if it determines that the applicant falls under any of the following categories, and shall have no obligation to disclose the reasons:
    1. If false information was provided in the registration application
    2. If the application is from a person who has previously violated these Terms
    3. If the Operator otherwise determines that registration is inappropriate

Article 4 (Management of User ID and Password)

  1. Users shall properly manage their Service user ID and password at their own responsibility.
  2. Users may not transfer, lend, or share their user ID and password with any third party under any circumstances. The Operator shall deem any login with a user ID and password combination that matches registered information to be use by the registered user.
  3. The Operator shall not be liable for any damages arising from the use of a user ID and password by a third party, except in cases of intentional misconduct or gross negligence by the Operator.

Article 5 (Eligibility)

  1. The Service is available to persons aged 13 and over.
  2. Persons aged 13 to 17 must obtain consent from a legal representative (such as a parent) before using the Service.
  3. Persons who have been suspended from use due to violation of these Terms may not re-register without the Operator's permission.

Article 6 (Prohibited Activities)

Users shall not engage in the following activities when using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that destroy or interfere with the functionality of the Operator's, other users', or third parties' servers or networks
  4. Acts that may interfere with the operation of the Service
  5. Acts of collecting or accumulating personal information of other users
  6. Unauthorized access or attempts thereof
  7. Impersonating other users
  8. Acts that directly or indirectly provide benefits to antisocial forces in connection with the Operator's services
  9. Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Operator, other users, or third parties
  10. Posting or transmitting content on the Service that contains or is judged by the Operator to contain:
    1. Excessively violent expressions
    2. Explicit sexual expressions
    3. Expressions that lead to discrimination based on race, nationality, creed, gender, social status, family origin, etc.
    4. Expressions that induce or promote suicide, self-harm, or drug abuse
    5. Other antisocial content that causes discomfort to others
  11. Acts whose purpose is or is judged by the Operator to be:
    1. Sales, advertising, solicitation, or other commercial activities (except those approved by the Operator)
    2. Sexual or obscene acts
    3. Meeting or dating strangers of the opposite sex
    4. Harassment or defamation of other users
    5. Causing disadvantage, damage, or discomfort to the Operator, other users, or third parties
    6. Using the Service for purposes different from its intended use
  12. Religious activities or solicitation to religious organizations
  13. Collecting Service data through automated means (scraping, crawling, etc.) without prior permission from the Operator
  14. Other acts deemed inappropriate by the Operator

Article 7 (User Content)

  1. Users warrant that they have the right to post content (photos, text, and other information, hereinafter "User Content") to the Service and that such content does not infringe on the rights of third parties.
  2. By posting User Content, users grant the Operator a non-exclusive license to use such content for the operation, improvement, and promotion of the Service.
  3. The Operator may delete User Content that violates these Terms or that the Operator deems inappropriate without prior notice.
  4. Even if a user deletes their account or User Content, the Operator may retain such content for a period necessary for backup, archiving, or legal compliance purposes.

Article 8 (Intellectual Property Rights)

  1. Intellectual property rights related to the Service (excluding User Content) belong to the Operator or those who have licensed the Operator.
  2. Users do not acquire the intellectual property rights of the Operator or its licensors by receiving permission to use the Service under these Terms.
  3. Users shall not reproduce, modify, publicly transmit, distribute, lend, or otherwise use the content of the Service without prior written consent from the Operator.

Article 9 (Suspension of Service)

  1. The Operator may suspend or interrupt all or part of the Service without prior notice to users if it determines that any of the following circumstances exist:
    1. When performing maintenance, inspection, or updates to the computer systems for the Service
    2. When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    3. When computers or communication lines are stopped due to an accident
    4. When the Operator otherwise determines that provision of the Service is difficult
  2. The Operator shall not be liable for any disadvantage or damage incurred by users or third parties due to the suspension or interruption of the Service, except in cases of intentional misconduct or gross negligence by the Operator.

Article 10 (Usage Restrictions and Registration Cancellation)

  1. The Operator may restrict all or part of a user's use of the Service or cancel their registration without prior notice if the user falls under any of the following:
    1. Violation of any provision of these Terms
    2. Discovery of false information in registered details
    3. Failure to respond to contact from the Operator for a certain period
    4. No use of the Service for a certain period since the last use
    5. If the Operator otherwise determines that use of the Service is inappropriate
  2. The Operator shall not be liable for any damages incurred by users due to actions taken by the Operator under this Article, except in cases of intentional misconduct or gross negligence by the Operator.

Article 11 (Withdrawal)

Users may withdraw from the Service through the withdrawal procedures prescribed by the Operator.

Article 12 (Disclaimer of Warranties and Limitation of Liability)

  1. The Operator does not warrant, expressly or impliedly, that the Service is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, rights infringement, etc.).
  2. The Operator shall not be liable for any damages incurred by users arising from the Service, except in cases of intentional misconduct or gross negligence by the Operator. However, this disclaimer shall not apply if the contract between the Operator and the user regarding the Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.
  3. Even in cases specified in the proviso of the preceding paragraph, the Operator shall not be liable for damages arising from special circumstances (including cases where the Operator or user foresaw or could have foreseen the occurrence of damage) among damages incurred by users due to default or tort caused by the Operator's negligence (excluding gross negligence).
  4. The Operator shall not be liable for any transactions, communications, or disputes that occur between users and other users or third parties in relation to the Service.

Article 13 (Changes to Service Content)

The Operator may change, add, or discontinue the content of the Service with prior notice to users, and users shall consent to this.

Article 14 (Changes to Terms)

  1. The Operator may change these Terms without individual consent from users in the following cases:
    1. When the change to these Terms is consistent with the general interests of users
    2. When the change to these Terms does not contradict the purpose of the Service usage contract and is reasonable in light of the necessity for the change, the appropriateness of the changed content, and other circumstances related to the change
  2. The Operator shall notify users in advance of any changes to these Terms under the preceding paragraph, including the fact that the Terms will be changed, the content of the changed Terms, and when the changes will take effect.

Article 15 (Handling of Personal Information)

The Operator shall appropriately handle personal information obtained through use of the Service in accordance with the Operator's Privacy Policy.

Article 16 (Notices or Communications)

Notices or communications between users and the Operator shall be made by the method prescribed by the Operator. Unless the Operator receives a change notification from a user in the format separately prescribed by the Operator, the Operator shall deem the currently registered contact information to be valid and send notices or communications to such contact information, which shall be deemed to have reached the user at the time of sending.

Article 17 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer or provide as security their contractual position or rights or obligations under these Terms to any third party without prior written consent from the Operator.

Article 18 (Severability)

Even if any provision or part of these Terms is determined to be invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions of these Terms and the remaining parts of any provision determined to be partially invalid or unenforceable shall continue to be fully effective.

Article 19 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Operator.

Article 20 (Affiliate Program)

The Service is a participant in the Amazon Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.co.jp.
